Get the Facts on Employment Law in San Jose
Employment law can be confusing to those not well-versed in law, sometimes leading to misunderstandings about the rights of both employees and employers. Confusion over employment law can lead to many employees and/or employers not receiving the fair treatment they deserve. At Polaris, our aim is to ensure that every worker understands their rights under employment law, and the recourse available to them in case there is a violation of such rights.
Know How Much You are Entitled to be Paid
Every worker in the state of California is entitled under the employment laws to receive a minimum hourly wage of $8.00. This law applies to both minors and adults in San Jose, and no employee or employer can negotiate for a worker to receive any less. If you are not receiving the minimum wage, the law states that you are entitled to file a lawsuit to receive compensation. Also, workers should be aware of the laws regarding overtime pay, tips and commissions.
Know When You are Entitled to a Break
California employment law states that for every four hours an employee works they are entitled to a ten minute paid rest period. Since the rest period is paid time, an employer has the right under the laws of employment to require an employee to stay on the premises during their break. They must however, provide a suitable area for their employees to rest. An employee who does not receive the rest time they are entitled to can choose to file a lawsuit to receive compensation for their time.
